Are perfume decants legal and safe to buy?

Decanting is a common practice, but a vial is only as trustworthy as the seller behind it. What we can say as plain facts, and a checklist for safe buying.

Are perfume decants legal and safe to buy? We are a shop, not a law firm, so we cannot give legal advice. What we can do is give you plain facts and a way to judge any seller. Decanting is a common practice, and nobody minds you pouring a little perfume you own into an atomizer for your own use. Selling decants to other people is a different thing, and that is where the questions about rules and safety begin.

What a seller takes on

Perfume counts as a cosmetic product in the EU, and cosmetic products come with rules about safety and about what a label must say. A seller who fills a vial and puts its own label on it takes responsibility for what is in the vial and what the label tells you. It is a reason to look at who the seller is, not a reason to avoid decants. The company details of a shop should be easy to find. Ours are on the about page: DecantGems is the sample department of FragranceGems B.V. in Zoetermeer, KVK 42180101.

Names and trademarks

A brand name belongs to its owner. A seller may use it to say which perfume is in the vial, and should not suggest that the brand made or approved the vial. That is why we write that a decant is not an official brand sample, that the house is not involved and that we are not affiliated with the houses. Pages that blur this line are a warning sign. The same goes for photos that make it look as if you receive the house's own product when you receive the seller's vial: the page should describe what arrives as it arrives.

Safe in the hand

Safety also has a practical side. Perfume is a flammable liquid, so keep vials away from flames and heat. It can irritate skin or eyes in some people, and it should be kept out of reach of children. If your skin is sensitive, try a small spot on the forearm first; can you test perfume with sensitive skin describes how. For anything medical, ask a doctor or pharmacist.

A checklist for any decant shop

  • A named company with a postal address and a registration number.
  • A stated source. The page should say the perfume comes from the original bottle and that nothing is added or diluted.
  • A readable label with the house, the perfume, the concentration and the size.
  • A real container, a glass spray vial with its own pump.
  • Honest wording about status: not an official brand sample, house not involved.
  • Visible conditions: shipping, returns and a way to reach a person.

The longer version, with the reasons, is in buying perfume samples in Europe. How a decant differs from a tester or a miniature is in decant, tester, brand sample or miniature.

Why the concentration line matters

The same name can hold different liquids. Byredo Bal d'Afrique exists as an Eau de Parfum and as an Absolu de Parfum. The Eau de Parfum is recorded with south African buchu, African marigold, bergamot and blackcurrant on top, cyclamen, jasmine petals and violet in the heart and tonka bean absolue, cedarwood, musks and vetiver in the base.

The Absolu is recorded with bergamot, black amber, blackcurrant and lemon on top, musks, praline and violet in the heart and cedarwood and vetiver in the base. Same name, different list, and only the label tells them apart in a drawer.

Amouage Guidance has the same pattern. Its Eau de Parfum form lists pear, frankincense and hazelnut on top, saffron, rose, jasmine sambac and osmanthus in the heart and cistus, sandalwood, akigalawood, ambergris and vanilla in the base. Guidance 46 is an Extrait de Parfum with a longer list.

How we work

FragranceGems buys the full bottle. We fill glass spray vials by hand with clean equipment, close them straight away and print the label ourselves. Nothing is diluted or mixed. You can read the full description on How we fill your sample, and the FAQ explains what to do if an order arrives damaged or wrong. If you want a legal answer for your own situation, ask a lawyer who knows consumer and cosmetics law. Before you order, what is a decant explains the basics and how to decant perfume at home shows the do-it-yourself side.

FAQ

Can you give legal advice on decants?

No. We are a shop, not a law firm. What we can do is describe how we work and what a seller should show, so that you can judge for yourself.

Is a decant from a shop as safe as the bottle?

It is the same liquid, but the container, the cleanliness and the label depend on the seller. That is why a checklist matters more than any promise.

Are decants affiliated with the brands?

No. A decant is filled by the seller from the original bottle. The house is not involved, and a trustworthy seller says so.
